General Terms Business
The service we offer at CycleMasters is a membership that provides access to fitness videos (referred to as ‘CycleMasters content’). These videos can be streamed to devices with an internet connection such as specific Smart TVs, computers, and other mobile devices. CycleMasters service is provided by CycleMasters B.V., a Dutch private limited liability company located at Jan van der Heydenstraat 26 in Bleiswijk, the Netherlands, registered with the Chamber of Commerce under registration number 74468065.
1 General
A CycleMasters Membership is automatically renewed on a monthly or yearly basis until you cancel it. To access the CycleMasters Service as a business user, you need to have a commercial license, internet access, and a CycleMasters-compatible device. You are also required to provide a valid accepted payment method, which you can update from time to time. By agreeing to the Terms of Use, you authorize us to charge your membership fees monthly or yearly for the upcoming period using the payment method you have selected, unless you cancel your membership before the billing date. Specific details regarding your CycleMasters membership can be found on the CycleMasters website under ‘My Account’.
2 Invoicing
2.1. The membership costs for the CycleMasters service and other related costs, like taxes or transaction fees, will be deducted monthly or yearly, depending on the selected membership. In some cases, we may change the payment date, for example if we couldn’t deduct an amount on the date you provided or if your paid membership starts on a day that doesn’t exist in a certain month. To view the payment date, go to the ‘My Account’ page on our website and click on the ‘Billing Information’ link.
2.2. For yearly memberships, you can also choose bank transfer as a payment option. During the registration process, when selecting the yearly membership, you can choose the ‘Bank Transfer’ option as your payment method. Your membership will be immediately active, and you will receive an invoice by email (and in your account) that can be paid within 14 days.
2.3. We offer you the option to change your payment method via our website, under ‘My Account’. In case of unsuccessful payment, due to insufficient funds or an expired expiry date, we may deny you access to the CycleMasters service until we receive a valid payment method selection from you. By selecting a payment method, you give us permission to deduct your membership costs monthly through the selected method. You remain personally responsible for unsuccessful payments, which may change the monthly billing date. Some payment methods may have associated costs, like exchange fees or other processing fees. For more information on this, you can contact the provider.
2.4. You can cancel your CycleMasters membership at any time. After cancellation, you will have access to the CycleMasters service until the end of your current billing period. We do not offer refunds or credits for unviewed CycleMasters content or partial periods. To cancel your CycleMasters membership, visit our website, go to the ‘My Account’ page, and follow the instructions. Upon cancellation, your account will be automatically closed at the end of your current billing period. You can check when your account will be closed on our website under ‘My Account’ and ‘Billing Information’.
2.5. We may change our memberships and service prices from time to time. These changes will only take effect 30 days after notification.
3 CycleMasters-service
3.1. To qualify for the CycleMasters membership, you must be at least 18 years old, or of legal age in your province, region, or country. Minors can only use our service under adult supervision.
3.2. During your CycleMasters membership, we grant you a non-transferable commercial license to view and use CycleMasters content. All content viewed through the CycleMasters service is intended solely for your members within your fitness club or corporate fitness center. No interest, ownership, or rights are transferred to you beyond this limited license. By accepting these Terms of Use, you agree not to use the service for public viewing outside of your business.
3.3. The available content and the number of devices on which you can view it may depend on factors such as geographical location and the type of subscription you have chosen. CycleMasters content can only be viewed in the country where you opened your account and in locations where we offer our service and have licensed the content. The content available for viewing is also subject to change.
3.4. The CycleMasters service, including the content catalog, is regularly updated by CycleMasters. To optimize the user experience, we continuously test various aspects of our service, including our user interface, website, promotions, and the availability of CycleMasters content.
3.5. In addition to the usual online CycleMasters content, we also offer certain offline content. You can temporarily download this content on supported devices (‘Offline Titles’). The maximum number of devices that can hold Offline Titles, the duration of their availability, the number of Offline Titles per device, and the period during which you can play them, depend in part on the type of subscription.
3.6. By accepting the Terms of Use, you agree to use the CycleMasters service, including all related features and amenities, in accordance with all applicable laws, regulations, and restrictions, including those related to the use or public display of the CycleMasters service or content. You also agree not to modify, distribute, reproduce, archive, display, perform, publish, license, sell, use, or create derivative works of information or content obtained from or through the CycleMasters service (except as expressly permitted in these Terms of Use). You also agree not to remove, bypass, modify, restrict, deactivate, or interfere with the content protection of the CycleMasters service; not to use spiders, scrappers, robots, or other automated means to access the CycleMasters service; not to decompile, disassemble, or reverse-engineer software or other services or products accessible through the CycleMasters service; not to insert code or manipulate products or CycleMasters content in any way. Furthermore, you agree not to use any method of data mining, extraction, or collection, and not to post, email, upload, transmit, or otherwise send or transfer any material intended to disrupt, limit, or disable the operation of telecommunication equipment, computer software, or hardware related to the CycleMasters service, including software viruses or other computer programs, files, or code. We reserve the right to limit or terminate your use of our service if you violate these Terms of Use or use the service in a fraudulent or illegal manner.
3.7. Based on standard playback settings, content is not played in HD quality over mobile networks. To play CycleMasters content in SD quality, you need an internet connection with a minimum speed of 0.5 Mbps, although we recommend a higher speed for better video quality. For HD content (defined as a resolution of 720p or higher), a minimum download speed of 5.0 Mbps per stream is required. The time it takes for CycleMasters content to start playing depends on multiple factors, including your location, the configuration of your (CycleMasters-compatible) device, the selected content, and the available bandwidth at that moment. Various factors affect the video quality of CycleMasters content, such as the playback device, available bandwidth, internet connection speed, and location, etc. These same factors can also be limiting factors in the availability of HD quality. Certain content is not available in every video quality, and not all memberships offer the ability to view content in every video quality. You are responsible for any internet access costs. For more information on the costs of using internet data, you should contact your internet provider.
3.8. To ensure the best user experience, updates are occasionally required for the CycleMasters software. This software and updates are developed by or for CycleMasters and designed to allow you to watch CycleMasters content on CycleMasters-compatible devices. The features and amenities of the CycleMasters software may vary by device. You agree to receive automatically updated versions of the CycleMasters software and related third-party software. You acknowledge that using the service may require third-party software subject to third-party licenses.
4 Passwords and account access
4.1. In order to maintain control over the account and prevent others from accessing it, the member who created the CycleMasters account and whose payment method is used to deduct the membership fees (the ‘Account Owner’) must retain control over CycleMasters-compatible devices that are used to access the service and must not disclose the password or payment method details linked to the account to anyone. You are responsible for the accuracy of the information you provide to us (regarding your account) and for updating it as needed. To protect you, CycleMasters, and our partners from identity theft or other fraudulent activities, we may (temporarily) block or remove your account.
4.2. You have the option to add three devices per account. These devices must be used within the same location and linked to the IP address to which the (main) account is also linked.
5 Intellectual Property Rights
5.1. All intellectual property rights and similar rights to protect information related to the website (including standard adjustments and updates), databases, documentation, equipment, or materials belong solely to CycleMasters.
5.2. All intellectual property rights of CycleMasters created or made available to you, in the context of its services, are exclusively owned by CycleMasters or its licensors.
5.3. Reproduction, disclosure, and copying of the services provided or made available by CycleMasters is not allowed without explicit permission from CycleMasters.
6 Liability
6.1. You are fully responsible for any use of the service. CycleMasters is never liable for any damage you may have caused to yourself or to others while performing actions listed on the website or using materials listed on the website.
6.2. The information and services on the website may contain technical inaccuracies and/or typographical errors. All information and data on the website are compiled with the greatest care. It is possible that there are inaccuracies and/or imperfections on the website. CycleMasters is not liable for damages resulting from inaccuracies and/or imperfections, problems caused by, or inherent in using the website, as well as technical malfunctions.
6.3. CycleMasters does not guarantee that the website is always accessible without interruptions or malfunctions. CycleMasters aims to keep the services accessible 7 days a week and 24 hours a day, but may interrupt access, including for maintenance, updating, and/or for any other technical reason.
6.4. CycleMasters is not liable for the damages you have suffered as a result of the interruptions described in point 3 of this article, unless the interruption caused by CycleMasters is unreasonably long.
6.5. CycleMasters is not responsible for texts, images, data, or files posted by other members on the website.
6.6. CycleMasters is never liable for physical injuries that occur while using the service.
6.7. CycleMasters is never liable for indirect damages, including consequential damages.
6.8. If CycleMasters is liable, the liability of CycleMasters for any reason is limited, per occurrence (where a related series of events is considered one event), to the actual fees paid by you to CycleMasters.
7 Various
7.1. These Terms of Use are subject to Dutch Law. The conditions described in these Terms of Use do not limit the mandatory legal consumer protection that you are entitled to under the applicable law in your country.
7.2. We do not accept unsolicited ideas or materials. We do not take responsibility for any possible similarity between CycleMasters content and ideas and materials shared with CycleMasters.
7.3. If you want to know more about our service and features or need help with your account, go to our website and check out the frequently asked questions (help.cyclemasters.com). If these Terms of Use conflict with information from customer support or other parts of our website, these Terms of Use will prevail.
7.4. If one or more provisions of these Terms of Use are considered unlawful, invalid, or unenforceable, the legality, validity, and enforceability of the remaining provisions remain unaffected.
7.5. These Terms of Use are subject to change by CycleMasters from time to time. When this happens, we will inform you at least 30 days before these new provisions take effect.
7.6. All communication regarding your account (such as invoices, notices, confirmation messages, password changes, and payment authorizations) will be sent to you solely in digital form, for example via email to the email address we have on file.
7.7. Dutch law applies to any agreement between CycleMasters and yourself.
7.8. Any disputes that arise between parties will be exclusively settled by the competent court in the Netherlands within whose jurisdiction the registered office of CycleMasters is located.
